Booking Conditions

BOOKING CONFIRMATION AND PAYMENT
The booking is confirmed with a deposit of 25% (50%  for Christmas and New Year bookings or bookings booked through Booking.Com) of the total rent plus fees and taxes. Payment of the balance of the rent is due a minimum of 40 days prior to arrival. If the rental start date is within 40 days of the booking date then the full payment will be due immediately. If the payment is not received at this point, we reserve the right to cancel your booking and levy cancellation charges as detailed below.

A damage deposit (see booking details) is due with payment of the rental payment. We reserve the right to require a larger damage deposit for groups of young people (a minimum of $2500).

Payment may be made by direct bank deposit, money order, Paypal, cashiers cheque or personal cheque (available for guest booking 14 days or more prior to arrival). The Guest(s) is responsible for any PayPal, bank and/or transaction charges. Guests are advised that payments made through Paypal are subject to a 3% surcharge.

Upon booking confirmation the primary renter shall scan and email to Owner a copy of either:
a) driver's license (For Canadian/US residents only)
or
b) passport (if resident  outside Canada/US)

for the primary renter and one other member of the booking group.
At the same time the primary renter shall provide a list of each individual guest’s first and last name,  age and address. This is for insurance and emergency purposes.


DAMAGE DEPOSIT
The damage deposit will be returned once the Owner's and/or the Owner's housekeeper(s) have deemed the house undamaged and satisfied themselves that nothing has been taken  and that all conditions in these Booking Conditions have been met. This is typically within 14 days of Guest departure. Any reason for delay in refund will be supplied to the Guest(s) in writing via email in a timely manner. The Guest(s) deposit will be returned to them either by bank transfer or PayPal (transfer fees may apply to each of these). Any repair or replacement costs (plus taxes and delivery fees) for any damaged or broken item/s will be taken out of the guests damage deposit.

The Guest(s) will be liable for any breakages or damage to the property or adjacent properties  which occur during the Guest's stay. These costs will be deducted from the damage deposit. Guest will indemnify and pay to the Owner any costs consequent on breakages or damage to the property  that exceed the amount of the damage deposit.

ALTERATIONS AND CANCELLATION BY GUEST
All alterations and cancellations by the Guest shall be notified to the Owners in writing and will come into effect on the day they are received. The Guest hereby agrees to indemnify Owners for any reasonable expenses incurred as a consequence of any alteration of the booking.  If a booking is cancelled, cancellation charges will be levied as follows:

- Prior to 60 days before your arrival (not less than 90 days for a booking over the Christmas and/or New Year holiday period(s)) the booking deposit shall be forfeited.
- Less than 60 days before arrival (not less than 60 days for a booking over the Christmas and/or New Year holiday period(s)) 100% of the rent payment shall be due and payable to Owners.


ALTERATIONS AND CANCELLATION BY OWNERS
The Owners may cancel any booking at their discretion at any time subject to refunding monies already paid by the Guest less any applicable administrative levy. In the unlikely event that any alteration is made by Owners which is deemed to be significant (for example, a change of booking date), the Guest may choose to cancel the holiday and receive a full refund of monies already paid. Owners shall not be liable for any refund for any cancellations  or alternations to the booking due to circumstances amounting to Force Majeure. Such Force Majeure circumstances shall include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, fire, technical problems, adverse weather, governmental action, government travel restrictions due to health reasons and similar events beyond our control.

CHECK-IN AND CHECK-OUT TIMES
Check in time is 4:30pm (local time).

Check out time is 10am (local time).

Flexible times may be available upon request and at an additional charge. Even if the Owners agree to the Guest(s) request if subsequently the Owners receive a booking that coincides with the Guest(s) late check out or early check in then the Guests shall comply with the standard check in and/or check out times as set out in this clause.
Check in and check out times are strictly enforced and the house code assigned to the Guest(s) booking will not work if the Guest(s) try to enter the property before their check in time or after their check out time.
If the Guest(s) do not vacate the property by the appointed time stated in this agreement or by the Owners a fee of CAD$200 per hour after the checkout time will be deducted from the damage deposit.

HOUSEKEEPING AND SERVICES
The Guest(s) agree that this is a self-catered rental property and that  daily housekeeping and/or meal service is not provided. Bedding, linens and bath towels are included in the rental rate along with a few basic items such as toilet paper, garbage bags and dish soap. The Owners do not permit towels, linens or bedding to be taken from the house. If the Guest(s) require a visit from the Owners housekeeping staff during Guest stay please let the Owners know with as much notice as possible and the Owners will try and arrange this. There will be an additional cost for this service to be determined by the Owners and/or housekeeper(s) if they are able to accommodate the Guest(s) request.

CONDITION  OF PROPERTY
The property is provided in “as is” condition.  The Owners shall not be held responsible for the failure of or damage to any appliances or amenities (such as internet access, Netflix TV or hot tub) but will take reasonable steps to correct any reported  failures or damage reported to the Owner. The Guest(s) agree to use the appliances and amenities supplied for their intended uses only and to take reasonable care in using such appliances and amenities. The Guest(s) acknowledges that use of amenities such as the hot tub, fireplaces, decks and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest(s)' own risk.

USE OF THE PROPERTY
The Guest(s) shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the property and keep the property in clean, tidy and sanitary condition at all times. The Guest(s) shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall the Guest(s) use the property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the property.
House Parties (or after-hours parties) are strictly prohibited

SHOES OFF
The Guest(s) agree to keep shoes off when inside the house  and to keep shoes in the garage or cloakroom entrance area.

QUIET TIME
Strata By-Law Quiet time is from 11pm (MST) to 7am. Any breach of this quiet time and/or any excessive noise at any time of the day or night will result in a fine and administrative charge being imposed and/or deduction from the damage deposit. Any complaints filed with the police or the Strata Manager/Neighbors will result in a CAN$500/infraction fine per incident and immediate eviction from the property without refund of the rental payment.

GUEST RESPONSIBILITIES
Guest(s) shall leave the property in a clean and tidy condition, including cleaning the BBQ and removing all trash and recycling items from the property. A penalty of CAN$500 will be charged and deducted from the damage deposit if all trash, recyling and/or guest food is not removed from the property by Guest.  Guest (s) is referred to the Welcome Pack for Guest's pre-departure cleaning and tidying responsibilities and shall comply with the same.
Guest(s) shall lock all doors and windows upon check out .
Guest will indemnify Owners for all losses and/or damage arising from any act and/or default and/or breach of these booking conditions on the part of Guest or any member of the Guest's party.

INSURANCE
It is the condition of every booking that the Guest and each member of the Guest's party is covered by personal holiday insurance, and that the policy covers Guest(s) adequately for winter sports, third party risks and costs incurred as a consequence of damage to property or adjacent properties during Guest stay caused by Guest(s) or any member of Guest group.

SPORTS AND ACTIVITIES
The Owners shall not be liable for any injuries, damage or loss to any person or property whatsoever and howsoever caused consequent upon or arising out of or in connection with Guest participation in or attendance at winter and/or summer sports and/or activities during Guest stay. Guest accepts that Guest and any member of the Guest's party skis and enjoy other winter and summer sports and/or activities at own risk within the restrictions imposed by the resort or other authorities..          

ANIMALS/PETS
No animals/pets are allowed in the property.

SMOKING

Smoking is strictly prohibited in or around the property (including the  garage). The Owners reserve the right to evict from the property and cancel the remainder of the booking without refund  any group breaking this condition.

If any smoking paraphernalia/odor is found in, or around the property the Guest(s) will forfeit their entire deposit plus any additional costs to replace damaged items caused by smoking.     

FIREPLACES
The Guest(s) shall not throw any paper or other combustible materials in the fireplace(s). The Guest(s) shall use all fireplace(s) responsibly.  No other fire is allowed anywhere on the property.

MINIMUM AGE REQUIREMENTS
At least one member of the party must be over 30 years old.


OCCUPANCY AND VISITORS
No additional persons other than those identified in the initial booking  shall reside at, visit or make use of the property at any time. No parties or gatherings of any kind without the express  advance written permission of Owners.   The Guest(s) agree that all members of the booking group  shall comply with these Booking Conditions
​CLEANING AND EXCESSIVE CLEANING COSTS

Guest is responsible for paying excessive cleaning costs (above the stated cleaning charge ). Anything that results in additional cleaning or extra work of any kind for the Owners and/or housekeeper(s) will result in an extra charge over and above the Cleaning Charge such extra charge  to be determined by the housekeeper(s) and/or Owners and shall be deducted from the damage deposit.

HOT TUB
Guest(s) must shower before entering the hot tub. The Guest(s) must adhere to the rules and guidelines posted on the exterior wall next to the patio door leading out of the living room.  These rules must be strictly adhered to for health and safety as well as operational reasons. The Owners will not be liable for any illness, injury or damages incurred due to breach of the said rules.
Children are not  permitted in the hot tub at any time without adult supervision.
When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk.

DO NOT STAND ON THE HOT TUB COVER. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and the Guest(s) will be charged for a replacement.
Remember when not using the hot tub; please leave the cover on so the hot tub will stay warm.
A deduction may be made from the damage deposit if Guests leave items in the hot tub or in the surrounding  area.
Blue towels are provided for guests when using the hot tub. White bathroom towels are not to be taken outside.
Breach of these rules shall result in deduction from the damage deposit.

WIFI
Guest(s) shall use the free internet service for legal purposes only and shall  not or permit the use of the internet router/service either wired or wireless for any illegal activity. Such activities include but are not limited to: downloading pirated software and/or movies, running an illegal business, streaming pirated material. If any illegal activity is found to have taken place during the guest(s) occupancy they agree to take full responsibility for their actions and to indemnify the Owners of any wrongdoing that may arise as a result of such activity. This includes but is not limited to any legal recourse and/or financial penalty taken by authorities against the Owners

PARKING
Campers, mobile homes, trailers, and tents are not allowed anywhere on the property.
Vehicles are to be parked in the garage or on the driveway.
The Guest(s) agree to use the parking area responsibly.
The Guest shall not park any vehicles outside the boundary of the driveway and shall not park any vehicle on the road.   The Strata imposes a fine of minimum CAN $200 per incident for parking on the road and any fine imposed will be deducted from the damage deposit.

ITEMS LEFT BEHIND
All personal property, furnishings, personal affects and other items brought into the Property by the Guest(s) shall be at the sole risk of the Guest(s) with regard to any theft, damage, destruction or other loss and the Owners shall not be responsible or liable for the same for any reason whatsoever. The Owners are not responsible for things that get left behind, however they will do their best to return  items to Guest subject to a a minimum charge of CAD$50.00 plus tax and postage. The Owners are not responsible if Guest(s) items are lost or damaged in the mail and Owners recommend that items are returned to Guest by registered post. The Owners and their agent(s) reserve the right to dispose of items left behind as they see fit if there is no claim after 30 days of Guest(s) checkout date

SECURITY CAMERAS
There is an external security camera in the front of the property. In addition, there is an interior security camera in the main entrance hallway. The interior security camera only covers the front door and door from the house  into the garage. It does not cover the vast majority of the entrance hall- way and does not cover any of the living areas including bedrooms, bathrooms, kitchen, dining area, living room, staircases, landings, laundry room, boot room or the exterior recreational areas including the  hot tub, BBQ and patio/deck. The interior security camera detects motion only and does not record audio. Guest(s) may unplug the interior security camera during Guest(s) stay but must plug back in prior to departure.  

BREACH OF BOOKING CONDITIONS
Material  breach of these Booking Conditions shall result in Guest(s) being immediately evicted from the property and forfeiting the rental payment plus damage deposit in whole along with any extra costs associated with each infraction.

INDEMNIFICATION AND HOLD HARMLESS; RIGHT OF ENTRY; ASSIGNMENT.
Guest(s) covenant and agree to indemnify and hold harmless the Owners and their agents, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by the Guest(s), permitted guests, visitors or agents, representatives or successors of the Guest(s) due to any claims relating to destruction of property or injury to persons or loss of life sustained by the Guest(s) or family, friends and visitors of the Guest(s) in or about the property. Guest(s) expressly agrees to save and hold the Owners harmless in all such cases.
Guest(s) agrees that the Owners(s) and/or its respective representatives may enter the property during reasonable hours to clean, inspect the property, to carry out repairs, improvements or alternatives thereto, as the Owners may deem appropriate.
Guest(s) shall not assign the booking reservation or sublet the property in whole or part without written permission of the Owners.
Guest(s) agrees that the booking reservation does not in any way constitute a residential tenancy agreement
